Terms of Service

These terms set the operating basis for enquiries and projects. An accepted proposal controls project-specific scope.

1. Contracting party

Local Web Works is a trading name used by Lucas Toh, with no UEN currently registered (Local Web Works, we, us).

Lucas Toh is the legal contracting person trading as Local Web Works. No UEN is currently registered. A correspondence address is supplied privately where needed for an invoice, proposal, contract or legal notice and is not published on the website.

2. Precedence and scope

A signed/accepted proposal or written scope identifies the deliverables, price, timeline, revision rounds, third-party costs and special terms for a project. If marketing copy conflicts with the accepted proposal or these Terms, the proposal controls for project-specific scope and these Terms control for general conditions, except where applicable law requires otherwise.

Work outside the agreed scope requires written approval and may change the price or timeline.

3. Free preview

The free preview is one non-production visual direction for the first two landing-page sections, normally the hero and one following section. It may be supplied as watermarked desktop/mobile stills or a controlled non-production preview.

  • No payment is due before preview approval.
  • Up to three specific, bounded changes inside the agreed preview direction are included. They are not three complete redesigns, new concepts, additional sections or scope changes.
  • The preview is not a completed website, production code, source file, editable design file, full copywriting service or launch-ready asset.
  • Ownership and reuse rights do not transfer with the free preview.
  • Local Web Works may decline or defer a request before starting based on fit, capacity, legality or missing inputs.
  • The usual target is 3-4 working days for a standard preview and 7 working days for a qualified Signature preview after fit, initial scope, capacity and required inputs are confirmed. The actual date is confirmed in writing. A scope change pauses the target and requires re-scoping.

The requester confirms they are authorised to supply and permit use of all submitted names, logos, images, copy and other material for the preview.

4. Project start and payment

Standard website projects use:

  • 50% project-start payment after preview approval, written scope, required content/access and commercial details are confirmed.
  • 50% final payment at launch readiness, after written staging acceptance or after included revision rounds are complete and the deliverable materially matches the written scope. Funds must clear before public launch, domain cutover, repository/source handoff or account transfer.

The project-start payment reserves capacity and becomes non-refundable once production work starts, except where applicable law or the accepted proposal requires otherwise. Third-party purchases require written approval and may be payable in advance.

Invoices are issued manually. Payment instructions are supplied privately and may use PayNow or bank transfer. The public website has no checkout and does not collect payment-account details.

If the customer disputes material scope conformity in good faith, they must identify the written-scope mismatch within five business days. Local Web Works receives one reasonable cure opportunity and responds with a correction or written scope explanation before treating the disputed final amount as due.

Late payment may pause work, launch, handoff, support or hosting after reasonable written notice, subject to applicable law.

5. Delivery timing

The public 3-4 working-day statement applies only to qualifying Essential and Enhanced builds after all start conditions are complete: approved scope, required content, account access and first payment. It refers to staging presentation, not necessarily public launch.

Custom and Signature websites, 2D/3D production, integrations, migrations, customer delays and third-party approvals use the timeline stated in the proposal. The seven-working-day Signature statement applies to the bounded free concept, not the complete paid build. Dates move where required inputs, feedback, access or approved third-party services are late.

6. Revision rounds

One revision round is one consolidated feedback submission from the named authorised approver against the agreed scope.

A revision round does not include a new concept, page, section, layout, feature, integration, strategy, content campaign or fragmented feedback from multiple stakeholders. Extra work is quoted and approved before it begins.

Feedback is due within five business days of a review request. After ten business days without required feedback or material, the project may pause and be rebooked subject to availability. After thirty calendar days without response, it may be marked dormant; completed work and committed costs may be invoiced. Dormancy is not automatic acceptance.

7. Staging, acceptance and cancellation

Local Web Works supplies a staging link or equivalent review artefact when the agreed work is ready for review. Acceptance occurs when the authorised approver confirms approval in writing or when included revision rounds are completed and the delivered work materially matches the written scope.

If the customer cancels after production begins, Local Web Works may retain amounts already paid and invoice reasonable additional amounts for completed work and reserved capacity. Any additional invoice is capped at the unpaid balance of the agreed project fee, plus approved third-party costs and signed change orders. Local Web Works will provide an itemised statement. Any mandatory cancellation or refund right takes precedence.

8. Ownership and licences

After full payment, the customer owns the bespoke final website code, customer-supplied content and bespoke deliverables expressly listed in the proposal.

Unless expressly included, ownership does not transfer for:

  • third-party software, fonts, stock assets, plugins, APIs or services, which remain under their licences;
  • Local Web Works reusable components, internal tooling, templates, know-how and pre-existing materials. For retained material embedded in the delivered site, the customer receives a perpetual, worldwide, royalty-free, non-exclusive licence to use, host, reproduce, modify and maintain it as part of the delivered site, appoint successor providers, and transfer the licence with the site or business. Standalone reuse is excluded unless stated;
  • editable design/source working files not listed as deliverables;
  • secrets or credentials belonging to Local Web Works or another customer.

The proposal must identify repository transfer, domain/account ownership, design files, content, licences and retained reusable materials. Local Web Works asks for written permission before publicly displaying a customer project, testimonial or result.

9. Signature and advanced-interaction boundaries

Signature pricing begins at SGD 3,900 and is quoted against the written quantities and complexity. A typical starting scope may include one highly crafted interactive landing page, up to two lighter supporting pages, one primary 2D/3D interaction system, up to two supporting motion sequences, responsive implementation and required reduced-motion/no-WebGL fallbacks. The accepted proposal controls the actual scope.

Unless expressly included, custom 3D modelling/animation, multiple real-time scenes, advanced shaders/configurators, large CMS/data migrations, e-commerce, authentication, web-application logic, multilingual content, complex integrations, photography/video, professional copywriting, full brand strategy and additional pages/interactions are separate.

Local Web Works may provide bounded communication assistance using client-supplied facts, including page structure, offer framing, headlines, calls to action and concise interface copy. This is not market validation, legal review or a guarantee of rankings, traffic, leads, conversions, sales, revenue, reputation or business success.

10. Third-party services and costs

Domains, hosting, email, payment-provider fees, transaction fees, booking providers, CMS services, APIs, paid tools, licences and other third-party costs are separate unless expressly included.

Before purchase, the customer receives the known cost, billing owner, renewal responsibility and material dependency. Local Web Works is not responsible for a third party’s outage, policy, price, approval, security incident or discontinued service, but will provide reasonable scoped assistance.

11. No-care handoff and defect warranty

Without monthly care, hosting/support ends at the agreed handoff date and the customer becomes responsible for hosting, monitoring, backups, security updates, analytics, edits and recovery.

A fourteen-calendar-day defect warranty covers reproducible faults where delivered functionality does not match the written scope. It excludes new requests, customer/third-party changes, content edits and external-service failures.

12. Monthly care

Care plans are month-to-month unless the proposal states otherwise. Business hours are Monday-Friday, 09:00-18:00 Singapore time, excluding Singapore public holidays. Response targets are acknowledgement/triage targets, not guaranteed resolution times.

A minor change request is one consolidated request affecting existing content, images, links, metadata or styling within the existing layout and requiring no more than approximately thirty minutes. It excludes new pages, sections, layouts, features, integrations, migrations, campaigns and redesigns.

  • Essential Care: one request/month; first response within three business days.
  • Full Care: two requests/month; first response within two business days.
  • SEO Care: up to four requests/month; first response within one business day; monthly agreed analytics/indexation report and bounded technical/on-page improvements; no ranking/traffic/lead/revenue guarantee.
  • Complete Care: up to six requests/month; same-business-day acknowledgement before 14:00, otherwise next business day; highest queue priority in business hours; one quarterly thirty-minute review call; no 24/7 emergency SLA.

Unused requests do not roll over. Overage/out-of-scope work requires approval. Cancellation applies before the next renewal; the current paid period is not refunded after work, hosting or reserved capacity begins except where law requires otherwise. Service continues through the paid period. Hosting ends at period close unless migration is arranged. If outstanding invoices are paid, the agreed export/handoff is made available before managed hosting ends. Local Web Works targets delivery within seven business days of a valid cancellation request and maintains a reasonable migration overlap through the paid period. Deployment history and customer content may be deleted thirty days after service ends, subject to legal/accounting retention and the Privacy Policy.

13. Customer responsibilities

The customer must provide accurate, lawful and authorised content, access and instructions; appoint one approver; review work promptly; maintain required third-party accounts; and comply with laws applying to their business, marketing, products, privacy, customer messages and claims.

14. Portfolio claims and publicity

Local Web Works will not publish a customer’s name, screenshots, testimonial, metrics or results without appropriate permission. Permission may specify channels and may be withdrawn prospectively, subject to reasonable time to remove controlled materials.

15. Liability, prohibited content and events outside control

Subject to liabilities that cannot lawfully be limited, Local Web Works' proposed aggregate liability arising from a project is capped at the amount the customer paid for that project. Where law permits, Local Web Works is not liable for indirect or consequential loss, including lost profits, lost business or lost opportunities.

Local Web Works may refuse, pause or remove work involving unlawful, deceptive, infringing, abusive or unsafe content, or instructions that would breach a provider's rules or applicable law. The customer remains responsible for the legality, accuracy and authorization of supplied content and business claims.

Neither party is responsible for delay caused by events reasonably outside its control, including provider outages, government action, natural events, widespread network failure or the other party's missing inputs. The affected party must notify the other where practical and resume performance reasonably promptly. Payment remains due for completed work and approved committed costs.

No term excludes or limits liability, consumer rights or other protections that cannot lawfully be excluded or limited.

16. Privacy

Personal data is handled under the Privacy Policy at /privacy. WhatsApp, email, hosting, analytics and third-party providers may process data under their own terms and policies.

17. Governing law and disputes

These Terms and project agreements are governed by Singapore law, and the parties submit to the courts of Singapore, subject to mandatory rights and any jurisdiction that applicable law requires.

Before formal proceedings, each party should give written notice of the issue and allow a reasonable opportunity to resolve it, without limiting urgent or mandatory legal rights.

18. Changes

Material changes to these Terms apply prospectively and show an updated date. Accepted project-specific terms are not changed retroactively without agreement, except where law requires otherwise.
